Recent developments in case law, along with the fast-paced and ever-changing landscape of AI, have significantly impacted certain arenas in scripted and non-scripted television development, deal making and production. This exclusive CLE partner event will cover the following: a deep look at the legal issues at play in “defamation by docudrama” cases – defamation claims that are all based on an unfavorable portrayal of a real person in a television program of motion picture based on real life events – and how to avoid them; how fair use under Andy Warhol Foundation v. Goldsmith will impact documentary television producers; how the Rogers test after Jack Daniels Properties v VIP Products impacts the use of third party brands in television productions; and a review of AI specific terms in the WGA and SAG 2023 MBA.
This in-person and virtual event will be hosted by HRTS Corporate member Weintraub Tobin and presented by HRTS Board Member Scott M. Hervey. Scott is a partner at Weintraub Tobin, where he represents studios, production companies, producers, directors, and showrunners, and is the co-lead of the Weintraub Tobin’s Business & Legal Affairs group, which provides outsourced comprehensive business, legal, and production affairs to studios and production companies.
